These terms govern how Spot The Plug KE may be used by participants and brands. By using the platform or participating in any campaign, you agree to these terms and the published rules of each campaign.

Spot The Plug KE campaigns are free-entry promotional marketing activities. No purchase or payment is required to enter or win. Rewards are brand-funded and governed by the published rules of each campaign. The platform is not a gambling, betting, or lottery operator.
Spot The Plug KE is a promotional campaign technology platform that provides campaign pages, published rules, comment-entry processing, winner selection workflows, Secret Vault offer delivery, reward administration, analytics, and campaign management support for brands and participants.
Spot The Plug KE is not a bank, financial institution, payment service provider, gambling operator, lottery organiser, or betting company. When a brand pays Spot The Plug KE for campaign services, that payment is revenue for campaign management. When Spot The Plug KE disburses a reward on behalf of a brand, that disbursement is a promotional expense within the campaign management service.
2. Nature of the Service
All campaigns hosted on Spot The Plug KE are free-entry promotional marketing activities. They are not lotteries, raffles, betting events, or gambling activities under Kenyan law.
No purchase or payment is required to enter or win any campaign
Rewards are brand-funded — provided by the campaign brand as a marketing expense
Winner selection is governed by the published rules of each campaign
Campaigns are classified as promotional marketing engagements, not games of chance
Participants do not stake money and cannot lose money by participating
Correct terminology. We refer to participants as “participants” (not players or gamblers), rewards as “brand-funded rewards” (not prizes or winnings), and campaigns as “promotional campaigns” (not raffles, lotteries, or games of chance).
3. Campaign Rules and Transparency
Each campaign is governed by its own published rules. Before a campaign is made available to participants, the following must be defined and published on the campaign page:
Entry method — how participants enter (e.g. comment the answer, guess the price)
Eligibility requirements — location, age, account criteria, and any restrictions
Winner selection method — correct answer, random selection, closest guess, or manual review
Number of winners or selected participants
Reward — what the selected winner or vault recipient receives
Campaign timeline — start date, closing date, and winner announcement date
No purchase necessary declaration
If there is any conflict between these Terms of Service and a campaign's published rules, the campaign-specific rules apply to that campaign.
4. Participant Responsibilities
By participating in any campaign, you agree to:
Follow the campaign instructions and comply with the published campaign rules
Provide accurate contact information, payment details, or preferences when requested for reward delivery
Submit only one entry per campaign unless multiple entries are expressly permitted
Not use bots, automated scripts, scrapers, or third-party software to enter or monitor campaigns
Not submit fraudulent, abusive, offensive, or non-compliant content
Not impersonate another person or use fake, shared, or duplicate accounts
Respond to winner notifications within the claim period stated in the campaign rules
Anti-automation. Our platform employs anomaly detection. Entries generated or assisted by automated means may be disqualified and accounts suspended without notice or recourse.
5. Brand Responsibilities
Brands using the platform to run campaigns agree to:
Provide accurate campaign information including reward details, product descriptions, and pricing
Fund and honour selected winners' rewards, vault offers, vouchers, and discounts
Ensure product availability and accurate descriptions for all campaign-linked products
Comply with applicable advertising, consumer protection, data protection, and promotional laws
Respond to participant inquiries and fulfil orders and rewards in a timely manner
Not submit misleading, offensive, illegal, or unsafe campaign content
Not run campaigns that would constitute a lottery, betting activity, or gambling event
Brands are solely responsible for product quality, delivery, returns, and after-sales support. Spot The Plug KE is not the seller of brand products and accepts no liability for brand fulfilment failures.
6. Winner Selection
Winner selection depends on the campaign's published rules. Available selection methods include:
Correct answer
First or all participants who provide the correct answer as configured.
Random selection
Random draw among all valid entries at campaign close.
Closest guess
Participant whose guess is numerically closest to the correct value.
Manual review
Brand-approved selection from eligible entries.
Our internal server logs and audit records are the sole, definitive record of entry timestamps
Network latency means comment order on Instagram may not reflect server receipt order
AI-assisted classification supports moderation but deterministic rules govern payout-triggering decisions
Winner selection outcomes are final and not subject to appeal except where fraud is demonstrated
A winner may be disqualified for fraud, duplicate entries, ineligibility, or failure to respond within the claim period
7. Rewards & Payouts
Rewards may include M-PESA cash payouts, vouchers, discount codes, product gifts, store credit, or other brand-specific benefits as described in the campaign rules.
All rewards are brand-funded — Spot The Plug KE disburses rewards on behalf of the campaign brand
Selected winners must claim rewards within the period stated in the campaign rules
Winners may be required to provide verified contact details, M-PESA number, or delivery information
Unclaimed rewards may be forfeited or reassigned at the organiser's discretion after the claim period expires
Spot The Plug KE is not liable for failed disbursements caused by incorrect details, Safaricom downtime, or wallet limits
Where a cash payout fails, Spot The Plug KE reserves the right to fulfil the reward via an alternative method of equal value
Rewards classified as promotional gifts — participants are solely responsible for any applicable personal tax obligations
8. Secret Vault Offers
The Secret Vault is a limited-time promotional offer delivered by DM to selected participants. Vault access is not guaranteed to all participants.
Vault recipients are selected based on campaign-configured criteria — random selection, engagement score, or other rules
Vault offers may include discount codes, product carousels, vouchers, affiliate links, or limited-time store offers
Each offer may carry an expiry time, usage limit, product restriction, or minimum purchase requirement
The campaign brand is responsible for honouring valid vault offers
Spot The Plug KE is not responsible for brand failure to honour a vault offer after delivery
Vault offers are promotional offers — they are not prizes, cash equivalents, or guaranteed entitlements
9. Acceptable Use
All users of Spot The Plug KE must use the platform only for lawful purposes and in accordance with these terms. The following are expressly prohibited:
Using bots, scripts, or automation to enter campaigns or monitor platform activity
Submitting duplicate, fraudulent, or non-compliant campaign entries
Attempting to bypass entry controls, eligibility rules, or campaign access restrictions
Impersonating another person or using fake, shared, or purchased social accounts
Presenting Spot The Plug KE campaigns as sponsored or administered by Instagram or Meta
Scraping, redistributing, or reselling campaign data or platform content
Running campaigns that constitute lotteries, betting, or paid-entry competitions
Uploading misleading, offensive, or legally non-compliant campaign content
10. AI-Assisted Features
Spot The Plug KE uses AI to support campaign operations including comment classification, answer extraction, spam detection, entry validation, winner suggestion, campaign copy generation, and audience interaction support.
AI evaluates responses based on parameters configured by the campaign brand
AI may reject responses with typos, heavy slang, or abbreviations not configured as acceptable variations
AI evaluation for non-payout decisions (spam filtering, answer classification) is final
For payout-triggering decisions, deterministic rules and manual review may apply
AI outputs may be reviewed, corrected, or overridden by the platform or brand
Spot The Plug KE does not guarantee AI accuracy and is not liable for AI classification errors in low-stakes contexts
By participating, you acknowledge that AI evaluation of your entry is based on pre-configured rules and is not subject to appeal in non-payout contexts.
11. Intellectual Property
Campaign pages, published rules, audit trails, platform materials, branding, and creative assets produced by Spot The Plug KE are owned by Spot The Plug KE or its licensors.
You may not copy, scrape, redistribute, or resell platform content without written permission
Brands retain ownership of their own campaign content, product images, and brand assets
By submitting content to the platform, brands grant Spot The Plug KE a licence to display and use that content for campaign operations
Spot The Plug KE may reference campaign performance, brand names, and results for case studies unless the brand has opted out in writing
12. Liability & Disclaimers
Spot The Plug KE does not guarantee campaign reach, audience size, sales, conversions, follower growth, or revenue. Campaign performance depends on brand quality, offer strength, audience interest, platform algorithms, timing, creative quality, and market conditions.
To the extent permitted by Kenyan law, Spot The Plug KE is not liable for:
Indirect losses, lost profits, lost sales, or loss of data
Brand fulfilment failures — non-delivery of rewards, products, or vault offers by the brand
Platform restrictions or account limitations imposed by Instagram, Meta, or other third parties
Safaricom or M-PESA service downtime affecting reward disbursement
User disputes arising from brand misrepresentation of campaign terms
AI classification errors in non-payout contexts
Our total liability in any circumstance is limited to the fees paid for the relevant campaign service during the 30 days preceding the claim.
13. Platform Dependency
Campaigns rely on third-party platforms including Instagram, Meta, Safaricom M-PESA, and other services. Spot The Plug KE is not responsible for:
Instagram or Meta downtime, policy changes, API restrictions, or account limitations
M-PESA or Daraja API service interruptions affecting reward disbursement
Message delivery failures caused by platform restrictions or rate limits
Changes to social platform rules that affect campaign entry, DM delivery, or comment access
Where a third-party failure affects a campaign, Spot The Plug KE will make reasonable efforts to complete the campaign via an alternative method where feasible.
14. Changes, Suspension & Cancellation
Spot The Plug KE reserves the right to update these terms at any time. Material changes will be communicated via the platform or by email where contact details are held.
Access may be suspended or terminated for misuse, fraud, non-payment, abusive conduct, or violation of these terms
Campaigns may be paused or cancelled if fraud, technical failure, platform restrictions, or legal issues prevent fair administration
Campaign cancellation fees depend on campaign status — setup fees are non-refundable after setup begins
Continued use of the platform after a terms update constitutes acceptance of the revised terms
15. Governing Law
These Terms of Service are governed by the laws of the Republic of Kenya. Any disputes arising from these terms or from participation in a campaign shall be subject to the jurisdiction of Kenyan courts.
Campaigns are free-entry promotional marketing activities and are not governed by the Betting, Control and Licensing Board (BCLB) or classified as gambling, lotteries, or prize competitions under applicable Kenyan law.
